| IVF cycles the state covers | Maine requires four completed egg retrievals, and the number is in the RULE rather than the statute. 24-A M.R.S. § 4320-U mandates coverage of fertility diagnostic care, fertility treatment and fertility preservation without naming IVF or any cycle count; the Superintendent's Rule 865 supplies both. Rule 865 names 'in vitro fertilization, including in vitro fertilization using donor eggs', fresh and frozen embryo transfer, GIFT and ZIFT, and provides that a carrier 'shall not impose a separate visit maximum or procedure maximum on any fertility treatment other than limiting coverage for egg retrievals to the first four completed egg retrievals over the lifetime of the egg retrieval patient'. Cost-sharing is constrained too: no separate deductible, no higher copayments than comparable specialty services, and after the deductible the carrier must pay at least 80% of the cost. One provision worth knowing before you self-pay: 'Egg retrievals where the cost was not covered by any carrier, self-insured health plan, or governmental program shall not count toward the four completed egg retrieval limit' — so a cycle you paid for yourself does not burn one of the four. THE LIMIT THAT DECIDES WHETHER THIS REACHES YOU: a state insurance mandate binds only fully insured plans. A self-funded employer plan is preempted under ERISA, and KFF's 2025 employer survey puts 67% of covered workers — 80% at firms of 200 or more — in one.
